AP CM Jagan Govt to be dismissed?

In response to CM Jagan letter to CJI about acts of malfeasance by some Judges, a PIL has been filed in Supreme Court by lawyers G S Mani and Pradeep Kumar Yadav seeking dismissal of CM Jagan Mohan Reddy govt!

  1. The PIL mentioned that since CM Jagan has pending corruption cases against him and since he leveled allegations against siting SC judge without basis, his govt should be dismissed.

2. Another advocate Sunil Kumar Singh filed yet another petition that SC should issue a show cause notice to the Andhra CM for his “frivolous” accusations against a sitting SC judge and High Court judges.

3. Bar Council of India (BCI)issued a press statement severely condemning CM Jagan’s letter to CJI. BCI called it a “sinister act” and said CM is resorting to “pressure tactics” as he has criminal cases pending against him. Also, BCI said its high time prudent citizens of the country come forward to “defeat and demolish” the hidden agenda behind their “evil move”.

4. SCARA — Supreme Court Advocates on Record Association also released a statement that it condemns the act and it tends to “scandalize and breach the independence of the judiciary”

5. Delhi High Court BAR Association passed a resolution “unanimously and without reservation” that CM Jagan has unfairly and without reasons had cast serious aspersions on the Honorable SC Judge. The association said it condemns the letter in the “strongest possible terms”

6. In quite contrast AP Bar Council and Telangana Bar Council did not condemn the letter of CM Jagan!

Looking at the coordinated attack by a section of lawyers, Common Man would have following questions.

  1. Should Supreme Court accept the PIL to dismiss Jagan govt? Would such a petition be qualified as something in “Public Interest”? Because Public has already shown its interest in People’s court by giving 151 out of 175 MLA seats to CM Jagan in 2019 election!
  2. If CM Jagan govt is to be dismissed since he has pending cases, why Election Commission of India allowed him to contest elections?
  3. CM Jagan submitted extensive documentation as evidence to support his allegation against the Judges he mentioned in his letter. Should the petition to dismiss his govt still be accepted since it says CM Jagan has written letter without any basis?
  4. AP High Court accepted a petition against Guest house construction in Vizag. The petition said Rashtrapati Bhavan occupies only 5 acres and so on that basis, AP govt plan to construct guest houses in 30 acres should be stopped. AP High court issued a stay on Guest house construction in Vizag. Later it turned out that Rashtrapati Bhavan in constructed in more than 300 acres! Common man may innocently ask why AP High Court accepted a petition which falsely claimed Rashtrapati Bhavan has only 5 acres?
  5. Bar Council of India did not call for a general body meeting or updated other leaders of Association before it released its statement to media. Should their statement be accepted?
  6. There are Delhi High Court lawyers who do not agree to Delhi Bar council resolution. Common man is confused how Delhi Bar council condemnation of CM Jagan letter should be viewed?
  7. In Jan 2018, 4 Supreme Court judges came out in open and commented against Chief Justice of India and also released their letter to India. Common man would like to know if Bar Council of India or Delhi Bar Council or SCARA had a response regarding that letter?
  8. It is to be noted that CM Jagan has written the letter in the capacity of CM of a State and not as President of his Political Party YSRCP. He was representing 5 crore population of Andhra Pradesh. Can a State CM be attacked in such a blatant manner by learned Lawyers of India?

Conclusion

In 1969, after election, President V V Giri was alleged of corrupt practices in winning the Presidential election. Being President of India, V V Giri chose to appear in person in Court to defend himself. Indian Constitution says, No one is above Law. V V Giri appearing in court is the best example of it. Instead of asking for an inquiry into Chief Minister’s allegations, a section of individuals are acting to influence judiciary to discard CM Jagan’s letter. In the spirit of constitution, all prudent citizens of India should ask for truth to be unearthed and uphold the Dharma of the nation.

Because as per Indian Constitution — Truth alone Wins (Satyameva Jayathe)!!
